Umm.. Who decided this?

Yesterday we talked about the BOCC agenda and how there was an item on there that did not have backup material as required by the Administrative Regulations.

Today, we are going to talk about an agenda item that is completely missing.

The final Impact Fee Hearing

You see, on March 31st, the commissioners voted 5-0 to approve the consent agenda. In the consent agenda was this item as C.20.

The thing with the consent agenda is that the board generally does not discuss these items. They are generally approved as written.

Here is the administrative regulation regarding the consent agenda:

No one pulled this item to discuss it, so there was no discussion and thus the vote to approve 5-0 as written.

Clearly, this was a vote to approve the schedule for the 2nd Impact Fee workshop and the final public hearing. The workshop on the 14th happened as scheduled, however, where is the April 26, 2026 meeting?

Yes, that falls on a Sunday, so this is likely a typo and should have said the 28th, but it is in TWO locations on that approved agenda item with that date. Regardless of the mistake, it requires board action to resolve it. Since the board did NOT do that last meeting, I would argue that they are required to have a meeting on April 26th, as stated in their motion to approve the agenda item.

So... See you all on the 26th for the Impact Fee public hearing at 1:30pm?

Yeah not sure what happens if they do not have it on the 26th as they voted. At the very least this requires corrective action to fix the date issue. They have to bring it back to amend the error.

Assuming this was supposed to be the 28th, why is this NOT on the agenda for the 28th? Looking at the agenda for next week, no mention of an Impact Fee public hearing. This meeting also requires notice to be placed in the newspaper, so I will reach out to the county to see when they filed that notice. Assuming they noticed it as required, how can they decide to just not have the public hearing now? Even if they did not notice it for whatever reason, the vote is still there to hold this meeting. That cannot be ignored.

In any case, that does not answer the question of who took this off of the agenda? It was clear on the 31st that the board made a vote on the agenda item to have the final public hearing for the Impact Fee ordinance on April 26th (28th)... so why is that not on the agenda?

Again, this requires board action to rescind their vote and remove it from the agenda. That did not happen. No action last week took place aside from the public workshop in which staff said it would come back at a future date... but that future date is the 26th (28th), as directed by the board's vote on March 31st.

How can someone ignore that vote and just not put this on the agenda? This comes down to the county administrator and county attorney as they are the ones responsible for the agenda items. One of them made the decision to remove this from the agenda or just not put it on there. Who was it and why? Who authorized them to do it?

If something has changed somehow, then the process should be to keep it on the agenda and commissioners can then vote during that portion of the meeting to change whatever it is they want to change and bring it back later. Their discussion during the public workshop last week suggested no changes were going to be made, so not sure what could have happened as that was the 2nd public workshop and I would think if there were an issue, it would have been raised before now.

So what has changed? How does that change overturn the vote to put the public hearing on the agenda? Why are they ignoring clear board direction to put this on the agenda and simply not doing it?

What is going on in this County? Clearly there are issues. These are easy mistakes to avoid, but here we are.
